General Data Protection Regulation
The Financial Conduct Authority (FCA) is the independent regulator of financial services. The Financial Conduct Authority require us to provide you with a document called an 'Initial Disclosure Document'. This document provides information about us, the products and services we provide, what we charge for our services, who regulates us, and what to do if you have a complaint.
Use Of Your Information By Hot Car Leasing®, Credit Reference and Fraud Prevention Agencies
When you apply for finance from a finance provider, you must provide us with certain personal information which we will then share with finance houses. They will share this information with Credit Reference and Fraud Prevention Agencies as this is necessary to help the finance company decide whether to offer you finance. If you do not provide it to us, then they may not be able to offer you finance. Your information will be used by us and these agencies as follows:
-
They will check records about you and others held by them, and also by Credit Reference and Fraud Prevention agencies. E.g. to assess your application for credit and verify identities to prevent and detect, crime and money laundering. The Credit Reference Agencies will record a search footprint on your credit file which may be seen by other lenders. They will also supply public information (e.g. information held on the electoral register) plus shared credit and fraud prevention information. The Fraud Prevention Agencies will use your personal information to prevent fraud and money-laundering and also to verify your identity.
-
If you advise us of a director, a spouse or a financial associate, then they may/will link your records together. You must ensure that you have their confirmation beforehand, to disclose their information. Credit Reference Agencies also link your records together. The links that are created, will remain on your and their files, until such a time as you or they successfully file for disassociation with the Credit Reference Agencies to have this link broken.
-
If you provide us false/inaccurate information or if they suspect or identify fraud, then they will record this and they may also pass this information on to Fraud Prevention Agencies and other such organisations involved in crime prevention. Please note that Law enforcement agencies may also access and use this information. If fraud is detected, then you could be refused certain services, finance or employment.
-
We and other organisations may access and use, from other countries, the information recorded by Fraud Prevention Agencies. These may be publicly-available sources. Any information provided may/will be kept on file for up to 6 years. Should you decide not proceed with your leasing deal, you do have the right to request that we delete any information that we hold about you.
-
Please note that we may also need to share your information with motor manufacturers, dealers and/or delivery companies in order to arrange and execute delivery of your vehicle to you.
Your data and information may also be used for other purposes for which you give your permission, or when required by law (or where permitted by relevant data protection and privacy law). Our lawful grounds for using your information include doing so to comply with our legal obligations or for our legitimate interests, e.g. to ensure that we are able to provide offers of finance that may be of interest to you, to ensure that our services/processes function correctly, prevent fraud and money laundering and also to ensure that our records are accurate and up to date. When applying for finance, you have certain rights where Finance Houses use automated decision-making tools to help them decide whether or not to offer you finance, for example, if you fail the credit checks for any reason, you can ask for the reasons why this is the case.
